Data Protection Statement

This data protection declaration applies to the processing of your data, namely your personal data, via the Internet site "jdownloader.org" with its services and sub-pages (platform). Responsible for data processing is AppWork GmbH from Abenberg,Germany (operator). The e-mail address of the operator is: e-mail@appwork.org. The complete contact data can be found in the imprint. The platform serves the development, distribution and support of the "JDownloader" program and the "MyJDownloader" service. You can access the contents of this declaration at any time via the subpage of the same name on the platform.

I. Preface

The operator takes the protection of your data seriously and adheres to the laws on data protection. These laws serve to protect natural persons in the processing of personal data. Personal data is all information relating to an identified or identifiable natural person. Such data will only be processed to the extent necessary to process the contract or to provide and improve the platform. Processing for contract execution only takes place if you initiate or conclude a contract with the operator; in this respect, reference is also made to the operator's terms of use. Processing for provision and improvement shall only take place if this is stated below or in a separate consent, ordered by the authorities or courts or otherwise provided for by law. The data are processed by the operator or by contractors for the operator only in the Member States of the European Union (EU). In particular, the Internet servers used by the operator for data processing are located in the EU Member States. A transfer to a third country or an international organization does not take place in principle.

II. Data processing

Your data will be processed form-dependent and form-independent. Depending on the form, this is the data that you enter in a form on the platform. These are the data that you leave behind when using the platform, even without such information. The data you provide in a form on the platform will be processed when you use the form, in particular after submitting the form. This may include, in particular, contact data, contributions to the platform and data on a user account. Personal data that you send via a form provided for this purpose are always transmitted to the operator's servers in encrypted form. The data required by the operator for the provision or improvement of the platform is processed independently of forms. This may include cookies, your (anonymized) IP address and statistical data. Even in form-independent processing, personal data is always transmitted in encrypted form, as far as this is technically possible.

1. Establishment of contact

You can contact the operator by e-mail or via a ticket system. You can contact us via the ticket system by filling out the appropriate form or by sending an e-mail to the address given on the platform. The data that you enter in a mail or form is transmitted to the operator's servers in encrypted form. This includes your request and contact information such as your name and e-mail address. The data will only be used to process your request. An answer is always sent by e-mail, which is also encrypted if supported by your mail service provider. If contact is made via the ticket system, developers can also view the data provided in order to process your request. Your request will be stored as a ticket in the system. The developers are obliged to treat personal data confidentially. You can also view your tickets and any answers in the system. For this purpose, the operator will provide you with access data (user name and password) on request. After final processing of the inquiry your personal data, which you have indicated in the form or the e-mail, will be deleted again. This will make your request anonymous in the ticket system. However, data cannot be deleted as long as it is still required for evidentiary purposes or as long as there are legal storage obligations to the contrary. The data is stored separately from other data that you enter or leave on the platform and is not merged with it.

2. Internet Forum

You can create an user account for the forum on the platform. This internet forum serves the exchange between users, developers and the operator. The data entered in the user account during setup and, if necessary, later via the forms, are transmitted in encrypted form and stored on the operator's servers. These are user data such as your name or a pseudonym, your e-mail address and a password. You can view the data at any time via the user account (with the exception of the password, which is not saved as such) and via the forms in the settings. You can publish posts in the forum using the corresponding forms. The data entered in such a form, namely your post, is also transmitted in encrypted form and stored on the server. The data will only be used to publish your post, whereby in addition to the post, the time of the post and general user data will be published. The general user data is data such as your name or pseudonym, but not your e-mail address or password. Your IP address, which the operator stores anonymously anyway, will also not be published. Your unpublished user data will not be passed on to third parties by the operator. You can delete your user account at any time via the settings. The deletion does not include posts that you have published in the forum. If you would also like to delete these posts, please contact the operator before deleting the user account, for example by e-mail. Your data cannot be deleted as long as it is still needed for evidentiary purposes or as long as there are legal storage obligations. Until then, however, processing will be restricted, in particular the user account will be blocked. The data is stored separately from other data that you enter or leave on the platform and is not merged with it.

3. JDownloader

You can download the application "JDownloader" from the platform. The installation can be done via the application (installer) of another provider. The installer can contain advertising or offer the user the installation of optional software offers. The operator does not pass on any personal data to the installer provider that you provide or leave on the platform. The installer provider only transmits general installation data to the operator, such as the quota of successful installations, the operating system used and the countries in which the installations took place. These data serve statistical purposes and do not allow any identification of your person. The operator has no influence on the data processing carried out by the installer provider. In this respect, reference is made to the privacy policy of the responsible provider, as displayed or linked in the installer. After installation, the program can be updated via the platform without passing data to the installer provider. The operator only collects general update data such as the number of updates and the size of the total data transmitted (traffic). In addition, your IP address can be used to determine the country from which the update is being performed. However, the IP address is not stored. Nor does the data otherwise permit any identification of your person; in particular, your location will not be specified. The operator uses the data in order to have enough servers for the program update. The operator does not pass on the installation and update data to third parties. If you have problems with the application, you can voluntarily send the operator a log of the application execution. This helps the operator to improve the application. The log may contain personal data. Which data is involved depends on how and for what you use the application. Sometimes the content of the log can also depend on chance. You can and should therefore view the log before sending it to the operator. The operator does not assign the log to you separately. In particular, the log is stored separately from other data that you enter or leave on the platform and is not merged with it. The transmission and storage of the log is encrypted. The operator does not pass the log on to third parties. However, the operator can make the log accessible to developers who have to treat personal data confidentially. The log is only processed to fix the problem in one of the next application versions. The log is deleted after three months at the latest. For an earlier deletion you can contact the operator at any time, for example by e-mail via the address mentioned above. For a download, the application must transmit data to the servers from which you are downloading files. This is the data that a browser would also send to the servers, such as your IP address and the address (URL) of the file to be downloaded. In this respect, the operator has no influence on data processing, which is why reference is made to the data protection declaration of the respective server operator.

4. MyJDownloader

The platform offers the service MyJDownloader. With this service you can operate an installation of "JDownloader" running on your computer. The service offers you an interface (API), an interface on the platform (web interface), an extension for Internet browsers (browser extension) and a mobile application for Android devices (app). To use the service, you must first set up an user account and link the account to your "JDownloader" installation. During the account setup, user data such as your e-mail address and a password are stored encrypted on the servers of the operator. You can view the data at any time via the user account (with the exception of the password, which is not saved as such) and via the forms in the settings. An ID is processed to link the account to the program installation. However, the operator cannot see the password you specified for the link in your "JDownloader" installation. The platform processes the accesses required by the service to operate the software (control commands). However, the operator cannot see which files you can download via the application or which data you can download via the service. Your IP address will not be stored either. The transmission of data between the application, the service and you is encrypted. The data is stored separately from other data that you enter or leave on the platform and is not merged with it. The operator does not pass your data on to third parties. You can delete your user account at any time via the settings. Your data cannot be deleted as long as it is still necessary for the execution of the contract, for the purpose of providing evidence or as long as there are legal storage obligations. Until then, however, processing will be restricted, in particular the user account will be blocked.

5. Cookies

The platform uses so-called cookies. These are small text files or simple entries in a database that your browser stores. The data in the cookies can only be read out again by the platform that has stored them. Cookies are used to make Internet pages more user-friendly and secure. Cookies containing personal data are only stored or read out via an encrypted connection. The platform uses so-called session cookies, in particular to recognize the registration in a possible customer account. These cookies ensure that only you can access the data stored in your user account after logging in. For this purpose, a so-called session ID is stored in the cookie. When you log out or end your visit to the platform, the cookie with the ID is deleted again, for example when you close your browser. In addition, the platform uses cookies to document any consent to personalised advertising. This cookie is not a session cookie. This means that the cookie remains stored after the end of your visit. However, it will be deleted at the latest one year after your last visit to the platform. For documentation purposes, the cookie stores the time and page (URL) at which or on which the consent was given. The data is stored separately from other data that you provide or leave on the platform, is not merged with it and otherwise does not allow any identification of your person. If you do not agree to such advertising, no cookie will be stored. The data will not be processed for other purposes and will not be passed on to third parties. The cookies used by the platform do not cause any damage to your end device (e.g. computer / tablet), in particular they do not contain viruses. You may refuse the use of cookies by selecting the appropriate settings on your browser, in which case you may not be able to use all features of the platform. The same applies to the deletion of stored cookies.

6. Advertising

The platform is financed in particular through advertising. This is what AdSense is used for on the website. AdSense is an advertising service provided by Google LLC, based in the USA, with Google Ireland Limited, based in Ireland, responsible for processing the data of users who reside in the European Economic Area (EEA) or Switzerland. In cases where data is transferred by Google to the USA, certification under the EU-U.S. Data Privacy Framework applies, for which the European Commission has determined that an adequate level of data protection is in place. Additionally, the operator has agreed to the Standard Contractual Clauses of the European Commission with Google to ensure an adequate level of data protection. Advertising can be delivered via AdSense on the platform. Advertising delivery can be personalized and non-personalized. In both cases, delivery is via an encrypted connection. To personalise advertising, Google uses cookies to create pseudonymous user profiles. These profiles can be assigned to advertising categories in order to deliver advertising tailored to target groups and interests. The operator cannot view such profiles. Advertising delivery on the platform is only personalized if you have consented to the use of cookies and personalization. Otherwise, the AdSense platform instructs AdSense not to deliver the advertising in a personalized form. In this respect, Google no longer uses a usage profile when delivering advertisements via the platform. If you have consented to personalised advertising on the platform, you can revoke this consent at any time by clicking the following link:

https://jdownloader.org/revoke_consent

At the same time, the operator regards the opt-out as an objection to the processing of personal data for the purpose of direct marketing. Opting out deletes the cookie that documents your consent. After that, the Google platform instructs again not to deliver any personalised advertising. The same applies if you delete the cookie via your browser or prevent the storage of cookies in advance via the corresponding setting. You can also use the following link to instruct Google not to deliver personalized advertising to you, regardless of the platform:

https://adssettings.google.com/?hl=en

For more information about the processing of personal information about AdSense, please see Google's privacy statement, which you can access by clicking on the link below:

https://policies.google.com/privacy?hl=en

7. Donations

In addition to advertising, the platform is also financed by voluntary payments from users to the operator (donations). Donations are made through payment service providers. Payment data such as your name, your e-mail address and your bank details, credit card data, the number of a PaySafe card or your Bitcoin address are required for processing the payment. If you enter this data in a donation form on the platform, the specified data will be transmitted to the payment service provider selected in the form. Data that you have entered in other forms or otherwise left on the platform is not transmitted by the operator. The transmission is encrypted. Except to the selected service provider the operator does not pass on the data given in the donation form to third parties. However, the payment service provider will notify the operator of your payment. The notification may contain your payment details. It is transmitted in encrypted form and stored by the operator. To prevent misuse, your IP address can also be stored anonymously. The data is stored separately from other data that you have entered or left on the platform and is not merged with it. They will be deleted as soon as there is no longer any legal obligation to retain data and the data is no longer required for evidentiary purposes. The same applies to donations which you make by transfer to the bank account of the operator and about which the operator is informed by his bank. For data processing by the payment service provider or your bank, their data protection declaration applies. You can access the data protection declarations of the payment service providers responsible in this respect via the following links:

III Legal bases

The legal regulations for data protection can be found in particular in the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). From 25 May 2018, however, the General Data Protection Regulation (GDPR) will take precedence. If you have given your express consent to the processing of your data, this is also the legal basis for data processing for the purposes to which you have consented (Art. 6 para. 1 letter a GDPR). In particular, this may involve the creation of a user account. Insofar as the processing is necessary for the performance or initiation of a contract, this constitutes the legal basis (Art. 6 para. 1 letter b GDPR). In particular, these may be contracts for the use of "MyJDownloader", which are concluded via the platform or initiated at your request. Furthermore, the legal basis for data processing is the protection of the legitimate interests of the operator (Art. 6 para. letter f GDPR). These are the economic interest (advertising) as well as the ideal interest (open source) in the operation of the platform. There is no automated decision making including profiling within the meaning of Art. 22 GDPR.

IV. Your rights

If you are affected by the processing of your personal data, you have rights under the data protection regulations against the person responsible for data processing. You can contact the operator at any time to assert these rights, for example by e-mail to the address stated above. The same applies to other questions concerning data protection by the operator.
In addition to the operator, you can also consult the data protection officer of the operator on all questions related to the processing of your personal data and the exercise of your rights.
Data protection officer of the operator: Attorney Daniel Raimer, Law Office Daniel Raimer, Ernst-Gnoß-Str. 22, 40219 Düsseldorf / Germany, E-Mail: privacy@appwork.org

1. right of revocation

According to art. 7 para. 3 GDPR you have the right to revoke your consent to data processing at any time. The revocation of consent shall not affect the legality of the processing carried out on the basis of the consent until revocation.

2. right of objection

In accordance with Art. 21 GDPR, you have the right to object at any time to the processing of personal data concerning you. This applies in particular also to an objection against the processing for the purpose of direct advertising.

3. right of appeal

Pursuant to Art. 77 GDPR, you have the right of appeal to a supervisory authority if you believe that the processing of personal data concerning you violates legal regulations. This right shall be without prejudice to any other administrative or judicial remedy.

4. right to information

According to Art. 15 GDPR, you have the right to request information from the operator. The right to information includes, in addition to further information, most of which can already be obtained from this declaration, in particular the right to a copy of your personal data which is the subject of the processing. The restrictions according to § 34 BDSG apply additionally to the right to information.

5. the right to correction

In accordance with Art. 16 GDPR, you have the right to request the operator to correct any inaccurate personal data concerning you without delay. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data, including by means of a supplementary declaration.

6. right to cancellation

In accordance with Art. 17 GDPR, you have the right to request the operator to delete personal data relating to you. If the data does not have to be deleted afterwards, you can demand a restriction of further processing if necessary. In addition, the restrictions according to § 35 BDSG apply to the right of cancellation. The right of cancellation includes the so-called right to be forgotten.

7. right of restriction

In accordance with Art. 18 GDPR, you have the right to request the operator to restrict the processing of your personal data. Thereafter, the data - apart from storage - may no longer be processed.

8. right to data transferability

According to Art. 20 GDPR, you have the right to the transferability of personal data concerning you, which you have provided to the operator. Your right to cancel remains unaffected.

9. notification requirement

In accordance with Art. 19 GDPR, the operator will notify all recipients to whom your personal data have been disclosed of any correction or deletion of these data or any restriction on processing, unless this proves impossible or involves a disproportionate effort. The operator will inform you of such recipients if you so request.
